The paper presents cross-cultural codes for rape, based on areconceptualization of rape, giving definitional precedence to femalechoice, across social norms. The social complexity of rape was indicatedby the fact that in 60% of the societies both normative (sociallycondoned) and non-normative rape were found in the same society,suggesting regulation rather than prohibition. The importance of codeconstruction due to the direct link between incidence rates andoperational definitions of rape is discussed.
